there is severe scarcity of water in some parts of the Tarakeswar Block.Please accord necessary instruction whether resinking of the existing tubewells and/or repairing of the same can be done outside/or far from the polling premises taking into view the Model Code of Conduct of the ensuing Parliament Election.

It has been observed by CMS squad that there are some buildings(private owner) where flags,festoons and wall writings of political Parties are fixed and those buidings are built on encroached land of PWD etc.Will it be considered as the defacement on pulic properties? Please clarify.

Sir,
1) There are cases where a government office is located on the ground floor and a private building on 1st floor(govt has hired the ground floor). Can any political party hoist flag or cause defacement of the 1st floor with written permission of private owner?
2) Certain issues have arisen where permission with respect of granting permission for meeting/procession are being given. Now, complications have arisen(based on complaints of all political parties) as to whether written permission of owner(s) of land is reqd(where meeting is being held) and on all such lands on which the procession follows? This becomes very complicated because it is not possible for police or BDO/SDO to know at that point of time who is/are the owner(s) of such land(s).
Kindly clarify on these two counts.

If building is privately owned, treat it as private. We can't go into land disputes now.
SDO Arambag:
(1)Since first floor, in your example, is not owned by govt, it will be treated as a private flat.
(2)I think thanas know the rules. You can't do a meeting unless the owner of the ground allows you to do so. Processions can go on public roads; if private property is encroached upon, the owner may lodge complaint, and prosecution started, on grounds of trespassing.

The proxy shall not be disqualified for registration as an elector, but he may not actually be an elector. In the latter case how could the proxy be identified by the presiding officer in absence of any short of photo ID?

In the format where different offices sent the employees' particulars for duties as p.p., there were provisions for some electoral details of each of them, which, for some of the employees of some offices, have not been furnished.
Now, will we pursue thru the respective nodal officers for filling it up, till those are furnished as such or we continue with preparing appt. letters, including them?

Your kind advice is needed in respect of the following points:
firstly, as per current convention and as detailed in the RO's hand book a polling premises in a rural area does not consist of more than two polling stations and in case of urban area which is restricted to two. Now, are we supposed to take into consideration the auxiliary booths in addition to the main booths while calculating the category of premises (i.e. single booth premises / double booth premises / triple booth premises etc. consideration ) in a constituency.
secondly,in case of enforcing model code of conduct, are to supposed to give cognizence to the permission letter signed by a shop/establishment owner in favour of a particular party when the concerned shop or establishment is found to have been built upon an encroached govt. land. At the same time whether party offices built upon encroached govt. land is allowed to display flags/festoon and other campaign materials.
thirdly,whether publishing and displaying of campaign materials like posters/festoons by a particular party with cartoons or animals having faces/
resembling faces of political opponents would amount to violation of model code of conduct

Proxy voters for Service voters need not be registered voters. Their identification, however, will be just like ordinary (non-EPIC) voters.
Please remember that indelible ink has to be applied to the MIDDLE finger of the proxy voter. I give below extracts from Presiding Officer's Handbook:
"The procedure of
identification, etc. will be applicable in the case of proxy also just as in the
case of other ordinary election. However, it may be noted that in the case
of proxy, marking of indelible ink will be done on the middle finger of the
left hand. The proxy will be entitled to vote on behalf of the CSV in addition to
the vote that he may cast in his own name if he is registered elector in the
constituency, at the polling station to which he has been normally assigned."

Try and get at least the EPIC number. Then the software provided by us will search the database and generate partno./sl no. automatically.
Do not insist too much, therefore, on all electoral particulars or else there will be delay. But it is necessary to capture at least the EPIC number so that after randomisation, the PP can be given duty within his own PC.
A good way to motivate people perhaps could be that unless they provide EPIC no. at least, they could be, by the computer, assigned to any random PC - far or near.

(1) Yes.
(2)Yes, no objection as we can't get into land disputes now.
(3)Since it would be a subjective interpretation, it would be wise to forward such complaints with photos to us.

The block livestock officer of khanakul-1 and khanakul-2 have refused to receive letters of their engagement as sector officer and welfare officer respectively citing order of the ECI that they have to be exempted from election duty.but that order is in respect of cattle extension officer only.Such refusal has led to vulnerability mapping and voter contact programme in respective polling station areas making no headway.To make matters worse,the bdo has no other available officer as replacement.An urgent instruction in this regard is requested.

As is customary,the tension between the political parties in general and area specific problems have really come to a boil in my district.i am also adm in charge of law and order in hooghly.now the question is:
there is a provision for impounding of all licensed fire-arms u/s 21 of Arms ACT.But promulgation is generally done a week or ten days before poll day.We r thinking in terms of issuing the said order by the.D.M.immediately after notification on 11th April,consideing situation in arambagh,most p.s.of serampore,dhaniakhali etc.Do we need special permission for doing so as is is seen from records that there was a D.O.letter from the then state election commissioner for issuing such order during last panchayat elections held in 2008?

Reg surrender of licenced arms, I may say that illegal/ unlicensed arms usually are the main culprits. So you should review thana-wise record of raids and recovery against illegal arms and ammunition.
Reg licenced arms, there is no objection to surrender in certain special category cases upon review by DM/SP including persons with criminal record etc as listed in the ECI circular
