Sir, the Presiding Officers' Handbook [Ch XIII, para 1.2] say that the PrO should affix his signature in full immediately below the serial number of the paper seal on the white surface of the paper seal. However, the green paper seals supplied to the district bears the serial no. on the green side. kindly advise. DPLO, Jalpaiguri & ARO, 3-jalpaiguri (SC) PC.
Sir One query regarding using flag & sticker on private vehicle. As per Jt. CEO's No ;- 144(19)- Home (Elec) dated the 15th January,2009, in para 5(a), it is stated that Private vehicles may put sticker or or flag on his vehicle on his own volition in such a manner that they do not cause inconvenience or distraction to the otehr road users. If such display of flags or stickers aim to solicit vote for any particular candidate then the provision of 171H of IPC would be attracted. My questions regarding private vehicles are:- 1) How it would be ascertained that one is soliciting vote for any candidate by sticking stickers and flagon his personal car? 2) If any person put a sticker containing symbol, picture of any candidate without soliciting vote in writing on his personal vehicle, will it attract above mentioned section? 3) Will Simply plying on the highway with flag of any political party attract this section?
Sir, A query regarding Wall writing... A poem by Kabi Sukanto is written in a Public wall, bearing no specific party symbol to ascertain the Pol Party's identity who has used these lines....whether it needs to be removed? In whose account the expenditure to be incurred? Whether the Gram PAnchayat can use public fund to remove it as suggested by the Observer? TMC has already complaind against this writing stating MCC violation. The writing says... "Priya ke amar Kerechis tora, Bhengechis Ghar Bari Se katha ki ami jibone marone, kakhono bhulte pari Aadim hinsra manabikatay jodi ami keo hoyee Swajan harano smashane toder Chita ami tulboi" Please advice, BDO, Kotulpur, Bankura
SDO Kurseong: (1)This is a subjective issue depending on interpretation that however must stand up to judicial scrutiny in the long run. However, if the words "Vote for XX" appears, then, at least in this case, the sticker will be construed as meant for soliciting votes. (2)-see above- (3)see above-
BDO Kotalpur: Examine the complaint. Issue notice without pre-judging, mentioning that "a complaint against you has been received as follows:...". Take a decision after getting reply.
Sir, 1) this is regarding casting of votes by personnel engaed in control room and other duties during the day of poll. A good number of staff are required to be engaged / deployed in control rooms and other duties in this district for smooth conduct of the ensuing election to the Lok Sabha, 2009. Their names may have been enrolled in distant places from their respective control rooms / place of duty in the same Parliamentary Constituency. As such they are required to be given the facility of casting their votes.
Now, instruction may kindly be given in respect of the procedure of casting of vote which may be adopted in respect of them and who will be the attesting authority of their signature for the purpose of filling up of the declarations. 2) When the person engaged in such duty is from an outside PC, whether he will be provided with the facility of postal ballot ( when vote in both of his home and working constituency is being taken in the same phase )and in that case who will be the attesting officer for his declaration 3) It has been advised that the sector officers will be provided with the facility of EDC. In that case whether Sector Officer or any such officer would specify their assigned duty at the space for noting down the name of the Polling Station in the application form 12 A ( or in 12 in case of PB allowed )
Sir, There are two feedback report formats for micro-observers. One with 39 points and the other having 17 points. Kindly advise on which format the micro-observers should report to the observer.
